Noteable cases:

In July 2005, I won an appeal which was a reversal of the trial court in the case of State v. D.S., 128 Wn.App. 569 (Div. II, 2005). My client wanted his juvenile conviction sealed and expunged, and was legally entitled to have it done, as my research discovered. The prosecutor and trial judge refused to allow it, so we appealed. The Court of Appeals agreed with my analysis and reversed the trial judge's decision.

I presented an appeal, State v. Rivera, (76 Wash.App 519, 888 P.2d 740 (DIV. 2 1995)), in which a visitor was searched during a search warrant. This case contributed to changing the law, which had formerly allowed visitors present during a warrant to be searched.

In September of 1994, I won a case in the Court of Appeals of Washington (In re S.V.B., 75 Wash. App. 762, 880 P.2d 80, Div. 2 1994), in which a father who had not been given sufficient services to cure parental deficiencies, had his rights terminated. I was successful in having this decision reversed on appeal.

  • Civil

Tip: Generally, an appeal only involves the verbatim record from the trial. Typically, new evidence cannot be included. New matters would be brought before the trial court.
